Thank you for providing critically important jobs to citizens of our
great state. I sincerely appreciate your contribution to Utah’s economy. Likewise, I am grateful for your commitment
to providing a safe and healthy workplace.
I encourage you to review your company safety plans and ensure you’re
protecting your employees. One way is to always have workers’ compensation (WC) insurance coverage. Accidents do happen.
In 2008, there were 68,432 reported workplace injuries. The Utah Labor Commission investigated 2,279 of over 86,000 Utah employers
for WC non-compliance.
By law, almost all employers must cover their employees with workers’
compensation insurance. In the event of a workplace injury or disease, workers’ compensation (WC)
pays medical costs and partial wage replacement during recovery, sometimes for a lifetime. WC insurance pays without regard to fault and its exclusive remedy protects Utah employers.
Any person or entity who employs one or more employees in the same business, under any contract of
hire, expressed or implied, oral or written, is considered an employer. Employers must secure WC coverage
by purchasing a WC policy from any Utah licensed WC insurance carrier, or by establishing a self-funded program authorized
by the Commission. Certain independent contractors with a purchased exclusionary waiver, agricultural and
domestic employers, and sole proprietors are exempt from Utah's WC laws. Employers with employees working
in other states must also comply with the WC laws of the other states.
In response to citizen calls,
the Utah Labor Commission is offering a new service available on the Commission website at www.laborcommission.utah.gov. Utahns
can quickly and confidentially validate if their employer provides WC coverage. The online poof of coverage
(POC) system called Workers’ CompCheck provides searchable information on Utah employers' WC insurance coverage
since 1986. The coverage data is electronically updated daily on the external website maintained by NCCI,
the National Council on Compensation Insurance, Inc. - the largest provider of workplace injury data and statistics in the
nation.
I encourage all Utah employers to make sure they have required workers compensation insurance and to
check out the new proof of coverage tool on the Utah Labor Commission website. For more specific information
